Your privacy is important to us. This Privacy Policy explains our practices regarding the collection, use, and disclosure of information we receive through our Services. It does not apply to any third-party websites, services, or applications, even if they are accessible through our Services.

  • We refer to our website as the "Site."

  • We refer to all the products and services we provide, individually and collectively, as the "Services."

  • We refer to you, the person or entity accessing our Site or using our Services, as "you," "your," or (if you purchase our Services) "customer."

Definitions

Data Controller

For purposes of data protection regulations, the "Data Controller" is the organization that decides the purposes and means for which any Personal Information is processed. Our customers act as the Data Controllers.

Data Processor

A "Data Processor" is an organization that processes Personal Information on behalf of a Data Controller. We act as the Data Processor for our customers and are bound by the requirements of the General Data Protection Regulation ("GDPR").

Data Processing

Data processing is any operation or set of operations (whether automated or not) performed upon Personal Information. Examples explicitly listed in the GDPR include: collection, recording, organizing, structuring, storing, adapting, altering, retrieving, consulting, using, disclosing by transmission, disseminating or making available, aligning or combining, restricting, erasure, or destruction.

Personal Information

"Personal Information" is any information about you from which you can be identified. It includes details such as your name, address, telephone number, or email address. It can also include information about your activities—such as data concerning your use of the Site or the Services—and demographic information (e.g., date of birth, gender, geographic area, preferences), if any of this information is linked to data that can identify an individual.

Personal Information does not include "aggregate" or otherwise non-personally identifiable information, which is information we collect about a group or category of products, services, or users where individual identities have been removed.

How Do We Collect Personal Information?

Acting as a Data Processor, we collect Personal Information from Data Controllers in several ways:

  1. Information You Provide to Us Directly.
  2. Information We Receive from Third Parties. We may receive information about you, including Personal Information, from third parties and combine it with information we already maintain. In such cases, this Privacy Policy governs any combined, personally identifiable data.

What Information Do We Collect?

We may collect the following types of Personal Information:

  • Your first and last name, username, and email address.
  • Your company's name.
  • Your (and/or your company's) physical address.
  • Information you choose to provide us through our Services (e.g., your birthdate or phone number).
  • Content you post to, or collect from, users of the Services, which we use to operate and provide features and functionality of the Services.
  • Aggregate information about the use of our Site and Services (e.g., browser and device data, such as IP address, device type, screen resolution, browser type, operating system, preferred language, pages visited, links clicked, and referring pages).
  • Information collected by third-party online advertising networks through cookies or similar tracking technology about your use of our Services and any of your mobile or web applications, in order to display ads relevant to your interests on our Services or other websites.

What Do We Use Your Personal Information For?

We use your Personal Information, in line with this Privacy Policy, to help us deliver and improve the Services. Possible uses include:

  • Operating, maintaining, and providing the features and functionality of the Services.
  • Compiling statistics and analyses about the use of our Site and Services.
  • Personalizing your experience.
  • Improving our Site and Services based on your feedback.
  • Enhancing customer service by more effectively responding to support needs.
  • Sending periodic emails with information relevant to your account, updates, and notifications about changes to our Services.
  • Enabling purchases or renewals if you choose to license our Services.
  • Marketing communications: We may send you email marketing about Proximality AI products and services, event invitations, or survey requests. You can opt out of these marketing communications as described in the "Your Choices" section below.
  • Legal obligations: We may disclose your Personal Information to comply with laws or legal processes or in response to lawful government requests.

We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose your Personal Information:

  • In response to claims or legal processes (including subpoenas).
  • To protect our property, rights, and safety, as well as those of any third party or the public at large.
  • To halt any illegal, unethical, or legally actionable activity.

We will request your consent before using or disclosing your Personal Information for any materially different purpose than those set forth in this Privacy Policy.

Your Choices About Your Personal Information

We may use the information we collect or receive to communicate directly with you, including sending email marketing communications about Proximality AI. If you do not wish to receive these emails, you will have the option to opt out. We will comply with your request as soon as reasonably practical. Even if you opt out of marketing communications, you may still receive administrative emails about the Services (e.g., account verification, purchase confirmations, billing reminders, changes or updates to Service features, technical and security notices).

You can also opt out of allowing third-party online advertising networks to collect information from our Site by adjusting the settings on your browser or mobile device. Please refer to the technical documentation for instructions on how to delete or disable cookies and other tracking tools.

Protection of Personal Information

Proximality AI takes reasonable measures to protect your Personal Information from unauthorized access, loss, alteration, or misuse. We maintain organizational, technical, and administrative safeguards appropriate to the level of risk. However, no data transmission or storage system can be 100% secure. If you believe your interaction with us is not secure, please contact us immediately.

You are responsible for maintaining the confidentiality of your passwords and account details, as well as for controlling access to email communications from Proximality AI. If we become aware of a breach affecting your Personal Information, we will notify you as quickly as possible and provide timely information about the breach, in accordance with applicable laws.

Data Handling and AI

  • Proximality AI does not use your data to train Artificial Intelligence models.
  • Proximality AI does not share customer data with third-party AI model providers for the purpose of improving their products or models.
  • We have Data Processing Addendums (DPAs) with our third-party model providers to ensure they do not use any customer data to improve their products or models.
  • If you wish to opt out of having any data sent from your Proximality AI account to a third-party integration (e.g., OpenAI, Anthropic, etc.), please email privacy@proximality.ai.
  • If you choose to execute AI-related features, some of your data may be sent to a third-party model provider for inference only, but not for the provider's model training or product improvement.

Cookies

We use cookies to:

  • Remember information so you do not have to re-enter it.
  • Understand and save your preferences for future visits.
  • Compile aggregate data about site traffic and site interaction.
  • Provide custom, personalized content, support, or information (including advertising).

Session cookies are deleted when you log off and close your browser. If you do not accept cookies, you may not be able to use all portions or features of the Site or Services. We do not currently respond to "Do Not Track" browser signals due to the lack of an industry standard.

Who at Proximality AI May Access Your Personal Information?

Designated staff members may access Personal Information to assist with:

  • Customer inquiries or support requests.
  • Investigating security issues.
  • Following up on bug reports or other technical matters.

Do We Disclose Any Information to Outside Parties?

Except as detailed below, we do not sell, trade, or transfer your Personal Information to outside parties:

  • We may share Personal Information with companies that are owned by or under common ownership with Proximality AI (including subsidiaries). Those companies will use your Personal Information in the same way as described here, unless otherwise noted.
  • We may disclose Personal Information to third-party service providers (e.g., payment processors, data storage providers) that help us deliver the Services. We limit Personal Information shared to what is reasonably necessary for them to perform their functions. These providers must keep such information confidential and secure.
  • We may work with third-party service providers to better understand our Site visitors. These service providers are not permitted to use the data except to help us conduct and improve our business.
  • We may release Personal Information when we believe it is necessary to comply with the law, enforce Site policies, or protect our rights, property, or safety, or that of others.
  • We may disclose Personal Information if required to:
  1. Comply with a legal obligation, such as a subpoena or court order.
  2. Enforce our Terms of Service (including investigations of potential violations).
  3. Investigate and defend ourselves against third-party claims or allegations.
  4. Protect against harm to the rights, property, or safety of Proximality AI, its users, or the public as required or permitted by law.
  5. Detect, prevent, or otherwise address criminal (including fraud or stalking), security, or technical issues.
  • If you enable public sharing of your Proximality AI applications, any information you voluntarily disclose in that application becomes publicly available. If you remove information you posted, copies may remain viewable in cached or archived pages, or if other users have copied or saved that information.
  • In the event of a corporate transaction (e.g., merger, reorganization, joint venture, assignment, sale, or change in ownership), we may share Personal Information to facilitate and complete the transaction.

How Do We Handle Global Transfers and Processing of Your Personal Information?

Your Personal Information may be stored and processed in any country where we have operations or engage service providers, including the United States or other countries outside of where you live. Some of our third-party providers may be in different countries. Where this is the case, we take steps to ensure your privacy rights are protected, consistent with this Privacy Policy. By submitting Personal Information, you agree to this transfer, storage, or processing.

If you are located in the European Economic Area or another jurisdiction with strict data protection laws, please note that we may transfer your Personal Information to countries or jurisdictions that do not have the same data protection laws as your own. However, we process all Personal Information in accordance with applicable law, including lawful requests by public authorities to meet national security or law enforcement requirements.

Retention of Your Personal Information

We retain your Personal Information for as long as needed to provide our Services. We may also retain Personal Information after you stop using our Services if necessary to comply with legal obligations. Where retained, we store Personal Information in accordance with any applicable retention periods imposed by law.

Third-Party Links

Our Services may contain links enabling you to visit other websites. These websites operate independently from us and have their own privacy policies, which we recommend reviewing. We are not responsible for the content or privacy practices of any linked site not owned or controlled by Proximality AI.

Your Consent

By using our Site, you consent to this Privacy Policy.

Minors

Our Services are not directed to individuals under the age of 13. We request that minors do not provide any Personal Information through the Services.

Your Rights

Depending on your jurisdiction, you may have certain legal rights with regard to your Personal Information, including:

  • Requesting a copy of your Personal Information.
  • Asking us to correct inaccurate, incomplete, or outdated Personal Information.
  • Asking us to transfer your Personal Information to other organizations.
  • Requesting erasure of certain categories or types of information. (If you choose to remove your Personal Information, note that we may retain archived copies as required by law or where we have a legitimate reason to do so.)
  • Restricting certain processing activities.
  • Objecting to processing activities. Where we have asked for your consent to process information, you can withdraw it at any time.

Changes to Our Privacy Policy

If we decide to change our Privacy Policy, we will post those changes here. If we intend to use previously collected Personal Information in a manner materially different from that stated at the time of collection, we will notify affected users via email and/or by posting a prominent notice on our Site for at least 30 days prior to such use or as otherwise required by law.
